Deadline to file a claim in Illinois’ Google Photo

If you're one of the many Illinois residents who use Google Photos, you may be entitled to a cash refund. A class action lawsuit alleges that Google violated Illinois law by collecting biometric data—specifically, faceprints—without users' consent. If you're an Illinois resident who has used Google Photos at any point since July 1, 2015, you have until this Sunday, November 3, to file a claim.

If you're not familiar with the lawsuit, here's a brief overview: In October 2019, a class action lawsuit was filed against Google, alleging that the company violated the Illinois Biometric Information Privacy Act (BIPA). The lawsuit alleges that Google collected and stored users' faceprints without their consent.

Under BIPA, companies are required to get written consent from Illinois residents before collecting, storing, or using their biometric information. The law also requires companies to notify Illinois residents of their right to opt-out of having their biometric information collected.

The lawsuit alleges that Google did not get written consent from Illinois residents before collecting their faceprints and did not notify them of their right to opt out. As a result, the lawsuit is seeking damages for Illinois residents who used Google Photos at any point since July 1, 2015.
